Legal Question in Family Law in Texas

Custody of Grandchild if daughter dies

My daughter which has complete custody of my grandson which is 6 has complete custody of her son. Her x husband which has spent time in the pen. He has no right to see son unless she is there also with her son. She said that now that her x is out he says that if something happens to her he will take her son and never let us the grandparents see my grandson again if she dies. My grandson spend about 60 % of the time with us since she is working and he is in school. She is worried to death that if something ever happen to us that he will take him away from us the grand parents. What can she do to not worry about this. She wants either us the grand parents or her sister and her husband to have him if something happens to her.

You definately need to talk to an attorney. This website is not appropriate to discuss all of your options.

I charge $100 to meet with you in person for an hour.

There are several options available to you.

Good luck!
