Legal Question in Family Law in Texas

custody

I have had my great granddaughter since she was born four years ago. Her mother has also lived with me.

The mother has got in some trouble and is now in jail. The babys father has her on the first, third and fifth weekends of the month. We let him take her early for Thanksgiving and now he won't give her back. He said his attorney told him not to. I have a paper signed by my granddaughter giving me temporary custody until she gets her business cleared up.I also have the papers that says when the father gets her. Is there anything we can do. The father said that in Texas there are no grandparents rights.

You need to move fast. Since you have had her a great deal of time, you can file for custody by filing a motion to modify in the Court that issued the first order setting forth everyone's rights and duties. It will be difficult but will only get harder as time goes by. Consult a family law attorney fast.

Unless the paper you have from your daughter is a court order, it is worthless. The father is partially correct. Grandparents rights are very limited and only come through the parents of the children. Only a lawyer can save you now, and it's going to be very difficult.
