Legal Question in Family Law in Texas

Custody

My husband left with our children while I was at work. He has moved them out of state. He took all of our money when he left. I cannot find help with the local police and do not have the resources to obtain an attorney. Is there anythin I can do?

The police will not get involved because there are no court orders, and he has the same rights to the children and the assets as you do. By the same token, courts frown on parents who run out with the marital property and the children, especially if they cannot establish some danger to the child from the other parent. I understand you do not have the money, but there are many free and low-cost agencies that offer legal services; and many good family lawyers will work on a reduced fee or payment arrangements. You may need to get a second job, but you NEED to get an attorney immediately, and be the first to the courthouse, and get an order establishing jurisdiction in a Texas court, and ordering the return of the children and assets. A Temporary Hearing will establish the rules while a divorce is pending.
