Legal Question in Family Law in Texas

Custody

My husband and I have lived in Texas for approximately 75 days and previously lived in Michigan. We are having marital problems and are seeking counseling, however, in the event that we do not work out my husband agreed that I can leave Texas and go back to Michigan with my son. My husband is willing to sign an agreement stating that. Will this hold up in court?

No, it might not hold up in court. The father might change his mind.

Right now, TX does not have jurisdiction. You must live here for 6 months in order to establish residency.

You might want to move back to MI now.

I don't how long you have to live in MI in order to file for divorce there.
