Custody Issue
My stepdaughters mom is married to a sex offender. He pleaded no contest to a second degree sex offense. The mother is very unstable and always seems to make bad choices. My husband and I are very stable and he has never missed a CS payment or visitation. We have been married for 7 years. The mother has been divorced and remarried after 32 days of her divorce. Will a Judge give my husband favor in this case? The mother has three kids, one from my husband and one from her x-husband and another from who knows. None of the kids living with her are the new husbands. He can't be alone with any of them per his Court orders.

I would say the sex offender issue would be a point that could result in a favorable outcome if properly presented. Bad choices could be a factor in that she is likely to leave one of the kids alone with the sex offender since she probably thinks he's an alright guy. I bet she would even tell that to the judge. You know, something like "He's a sweet guy, and he's never done anything around me". If this issue is important to you, I advise that you get a good lawyer and be prepared to pay the bill.

You have an excellent case for modification on your hands, and I don't think that she would have a choice but to relinquish custody.
