custody issue
Five years ago my sister gave legal guardianship of my nephew to my great aunt that resides in Houston,Texas. (We live in Louisiana.) My sister decided that she was financially able to take of him and decided she wanted him back. The only paper she signed was a notorized letter. My aunt threatened to leave without my sister knowing where they would be, so my sister took him and brought him back to Louisiana to live with her. Now my aunt is fighting for custody when there is no custody in place for the child. In her legal forms she names the child as someone differant than his legal name. Does she have grounds to do this? Also the father was not aware of the child and now he is and he also lives in Louisiana and is willing to claim paternity. you help would be greatly appreciated. Thanks

The child's mother is the legal guardian unless changed by court order. You should bring the pleadings file in La. to an attorney ASAP, as they will show you the court date on which the hearing is set.
