Legal Question in Family Law in Texas

custody and location

I have joint custody of our two children ages 10 and 2 with my ex-wife, the possession order states equal right down the middle between the both of us. The only restriction is that the children must reside in the Garland ISD, the mother lives in GISD but I just move 11miles out of the boundaries. Now she say the decree state that I cant take the kids for my weeks and odd days in between and if I want to have them I must move back into the GISD boundaries. What is the validity of her cause?

Re: custody and location

Does the order reflect that either parent is the primary conservator, even though it is a true joint arrangement? She may have grounds to prevail. You should consider filing a petition to modify the decree, to allow for your move. Arguably, you are still in close proximity, and your move would not alter the children' right to attend GISD.

Re: custody and location

The answer is within the terms of the order itself. If you have difficulty interpreting the terminology of the order, I suggest you hire a lawyer to assist you.
