Legal Question in Family Law in Texas

custody

ok i looked at my divorce decrete and it said i had sole managing cistody of my son and my ex had to see him through a visitaion program. well my ex has been in jail since my son was 14 month. my son will be 4 in 2 months. i want to move to california . i read mydivorce decrete it says i have the right to designate the primary residence of the child. ithats all it says , it doesnt say within any couty limits or anything. plain and simple. i remember my lawyer telling me i could live anywhere . ..any advice

If your decree does not restrict the child's residence, then it doesn't. It is accepted public policy that parents do not move away, in order to foster a continuous relationship with both parents. Since the child's dad is in jail, that does not seem to the issue.

If your decree does not contain a domicile restiction, and based on your description yours does not, then you are free to move anywhere you want, plain and simple.
