Custody after managing conservator charged with Agg sex assault
My 7 year old step daughter has lived with her dad. He is the managing conservator. Recently he was charged with 3 counts of Agg. sex assault of a child (against his daughter) and 1 count of sex assault on the kid next door). CPS removed her from his home and placed her with us. CPS advised us to get an attorney and get custody of her. She's a resident of Harris county and we are residents of Howard county, we're told that we'll have to file in Harris county. Is there anyway at all that we can file this in Howard county since she is residing with us in Howard county? The father has requested that she be put in foster care and according to CPS because he was managing conservator he has that right, even after what he is accused of doing to her. CPS says if we don't hurry she may be placed in foster care.
There must be a loop hole or law somewhere that allows for extenuating circumstances. We can't afford to fight this in Harris county, we don't qualify for legal aid and because we're not Harris county residents the pro bono groups won't help us.
Please, if you know anything at all that we can use, don't let this little girl end up in a system that is already overcrowded. A protective order is pending against the father.

It sounds like there is a court of continuing jurisdiction in Harris County, is that correct?
