Custody of Minor Child upon death of Custodial Parent

My ex-husband (AZ) recently passed away. We had both re-married. He was the custodial parent. I was the non with visitation rights to include summers, etc. She is currently with me in (TX). Upon his death can I automatically become the legal custodial parent? Thank you in advance.

You need a lawyer to modify the existing order. Child custody is not an asset.
