custody of neice

My brother is in jail filing for divorce. my sister-in-law moved out of her parents house and left my neice with them. my brother wants to transfer custody of her to me, but her parents want to terminate both their rights and adopt her. what can i do to gain custody?

You need to get a lawyer, and even then, it will be an uphill climb. Depending upon how long the child has been with the grandparents, they probably have standing. Your brother will have to fight to keep his parental rights. Only then will he have any argument as to who he wants to take conservatorship of his daughter. You may or may not have standing, of your own, to intervene.
