Legal Question in Family Law in Texas

Custody of Niece

This case is not in regard to my children. My situation is of a different nature. My brother has a daughter of 2 years that I want custody of. She lives in TX and has been relesed to her maternal grandmother right now who is unfit (smokes crack and has a live in boyfriend that does the same). My brother and the child's mother are in jail for murder. How can I file for temporary custody of the child. I have been getting the run around with Child Protective Services - No one there knows what they're doing and the abuse hotline number they gave me to call is continually busy so I have been unable to report for the last two days that I've been trying. We don't have a lot of money for legal fees either, what would be the most cost effective method for me? Any help would be greatly appreciated.

You can file a suit affecting the parent-child relationship (SAPCR). Sometimes in certain counties there are pro bono associations who do these cases on a reduced fee basis.
