Custody questions
I have a big questions my daughter is 1 and my husband may or may not be the father of her he did sign the aop when she was born and said the testing had not been done, now he wants to do dna test on her which is fine with me. The issue is that she may not be his and he wants custody of her and does not want me to have anything to do with her if we divorce, because of an ex that has been charged with sexual assualt of a 14 yr old girl i did not know this at first of us dating. He has done his time its been at least 5 yrs now he would never do anything to harm my daughter or anyone else he admits what he did is wrong and everything he does not live in texas anymore and my husband has hit me many times and is abusive toward me. he says if i leave him that i will never see her again and any judge would never give custody to me. Do i have any chance of getting custody of her at all cause of my ex even if shes not my husbands?

Please go hire a lawyer today. An ex that is no longer in the home and no longer has any contact with the family is no longer a threat, whether he has changed or not.
An abusive parent should never have primary conservatorship.
The biological issue should be resolved immediately.
You need a lawyer discuss and plan your way out of this mess. You could well be in a better position than you realize.
