who can get custody if something happens to me?

My ex and I have recently been divorced in the last couple of months. We have joint custody of our 3 year old daughter with me as the primary. She is soon going to be moving to Cali. to be with her Internet boyfreind. What I wanted to know is if there is a way that I can have stated in a will that someone else (my sister or mother for instance) can be named gaurdian of my daughter if something happens to me. It really scares me to think of my exwife raising her with the decisions that she makes.

The answer is "perhaps". This situation is much too complicated to discuss in an email. If you live in the Houston area, I offer a free phone consultation.

You need a probate attorney to write a will. I strongly urge you to have other documents done -- power of attorney for health care, directive to physician, future designation of guardian, etc. -- since you are now single. You need to designate someone to be in charge in case you are sick and unable to make medical decisions/financial decisions for yourself.
