my son is living with his girlfriend and they have a 1 yr son -- he getting ready to move out and wants to know if he has any rights to the baby. The baby has his last name and he is listed as the father on the birth cert.

He still need to go to court and be officially declared the father of this child.
I don't advise going to the Texas A G office to get this done.
He needs to hire a private attorney and file voluntary paternity.
