Custody suit
My daughter is being sued for full custody of her daughter by the father. A change of venue was granted by the judge in the county the suit was filed. A court date has never been set. Is it true that the plantiff has to pay a fee in the new county in order to proceed with the suit? If so, and the fee isn't paid, can't the defendant's attorney request a dismissal of the case?

It sounds like your daughter has an attorney. He or she will be familiar with the details of this matter and is the best one to try to answer your questions.

When a case is transferred from one county to another, the receiving District Clerk will send a notice to the party who requested the transfer that a filing fee needs to be paid. If the filing fee is not paid, the receiving county will not file the suit.
