Custody & Support Voluntarily Surrendered, Can Step-Father Adopt in Texas

I have 3 children from a previous marriage, I just received documentation from Lorain County, Ohio courts that the bio-logical father has voluntarily agreed to suspend visitation and child support effective 3/1/05. I live with my husband and 3 children in Texas, my husband wants to adopt the children. My ex-husband has not seen the children in over 2 years, has not had any contact via phone in over a year. Now child support has been ordered suspended since 3/1/05. Would it be possible for my husband to adopt them, and how would we go about it? We have lived in Texas for over 3 years. They are Texas residents.

It sounds like a good time to try to get your ex-husband to sign over his rights to the kids.

It would be a termination of parental rights and a Step-parent adoption.

Find a lawyer in your county that does step-parent adoptions.

They aren't hard (especially if the father agrees to terminate his rights) but there are things you MUST do and you cannot get around them.
