Legal Question in Family Law in Texas

Custody of a 14 year old child

My 14 year old daughter no longer wants to reside with her mother. Her mother relocates quite frequently and can never seem to establish a steady job. Last summer daughter and I visited an attorney and typed a reguest for permission to relocate with myself. She decided to return to her mothers as to not anger her. It seems to be quite a battle when it comes time for my daughter to visit me during each and every summer and during the Christmas holidays. She is with me now for the Christmas holidays and does not want to go back to her mothers. What if anything can be done immediately for a change in custody. Can a Judge issue emergency orders or grant a temporary injunction. Please answer as my daughter is terrified of her mother and is tire of the undo emotional stress being placed upon herself. Thank you tremendously for your time and your site is an excellent avenue for legal questions.

Re: Custody of a 14 year old child

As you daughter is 14 she can decide, subject to the Court's approval, which parent she like to reside with. In addition, you can seek temporary orders where your a judge can change custody temporarially pending a final hearing. This can be done within 14 days of filing a motion to modify. If you are in North Texas, call me if you like me to assist.
