Legal Question in Family Law in Texas

Custody

Hi,

Im a 31 year old male and have two daughters with my ex wife. We divorced in 2002 and wife got custody due to no funds on my behalf for an attorney. Since I recently been through college, got married and now have another child. In 2004 my ex wife dropped off my oldest daughter and told me to keep her. She has been living with me since. 5 years now.

She now wants my daughter back after 5 years and she is in no steady shape to take care of her. My daughter is a straight a student and perfect attendence in school. We have a very nice home and she is very well taken care of. She is 12 and my ex is trying to take her saying she still has custody.

My question is, what are my legal rights from stopping her from taking her? Please help.

Since you have been raising the child for over 6 months, you have standing to ask for custody.

I would immediately contact an attorney on Monday afternoon (most attorneys are in court on Monday mornings) and set up an appointment.

I recommend the attorneys on this website. They obviously care about education people.
