Custody/Visitation

I have an eight year old son. He is wanting to spend more time with me. If I go back to court to have visitation/custody re-visited will his wishes be taken into consideration?

Generally speaking, the judges do not want children brought to the courthouse to testify. However, in cases involving custody and possession time the court will often appoint a psychologist or counselor to do an evaluation or social study. That person will want to spend some time with the child and with you when you have possession of the child. That person will then file a report with the court that includes his/her observations about how well the child did when he was with you and probably some of the boy's comments about spending time with you. That report will indirectly get you boy's opinion into evidence for the judge to consider.
