Legal Question in Family Law in Texas

My daughter has 2 children by an ex-boyfriend. His name is not on the children's birth certificate. He is now saying that when he gets out of prison in a few months he is going to take the children. Can he legally do that?

No. What he CAN do is file a petition for paternity, and ask the Court to make a finding that he is the children's father. In connection with that, he CAN ask for custody. The chances that he would GET custody are probably zero.
