Legal Question in Family Law in Texas
My daughter has decided that she wants to move back home with me (Mom) . She is now 16 . She's lived here for the past 3 mos. . Her Father CP allowed her to move back home with me . Take all her things and bring them here . For the first 13 1/2 years she was with me (I was CP) . Then we had custody changed and I paid c/s (still paying ) Which leads me to my question . What happens to the money I paid the last 3 mos. ? Will I get that back ? ONLY reason why I am asking . Is I cover insurance , pay for all of our daughters needs with no help from my ex .
Will the judge see that since she is living with me , I should get that money back ? Because when we were changing custody from me to my ex . My daughter was living with my ex . And he wasn't paying the CS to me even though there was no order to stop . Which is fine with me . I just want to know will they do the same thing for me ?

You need to file a motion for modification immediately and let the court sort out the child support questions - reimbursement, etc.
