Legal Question in Family Law in Texas
Daughter
My girlfriend & I never married. We have a daughter together. We split up after she was born. When my ex gets mad at me, she won't let me see my daughter. I have not had her any Father's day at all. My daughter is mostly taken care of--name removed--my ex's mother. I want custody of her. I have a job, the ex doesn't. I have supplyed food, diapers, clothes, medicine, etc. The ex let my daughters medicade expire, and so now she is currently without any type of health insurance. She filed for custody but never went through with it.I also have a prision reord. There is a possiablity I might get picked up(because of fines,no trouble), so is there a way for my dad to take her if this happens? She will fight me for custody, so what do I need to do? Do I take her before I file since she lives with the ex & mother? I am on the birth certificate as her Father. Basically, I get to see her when my ex isn't mad at me or if it is convient for her. The ex told me if I (or anyone in my family) ever threated to call CPS, she would kill us. She is crazy enough too! Please help me with my options. I am grateful. Thank you.

Re: Daughter
And you have not hired a lawyer? Why not? Get a second job, pay off the fines; then hire a lawyer on a payment plan. You clearly understand the injustice of this, but if you walk into court, you are susceptible to being arrested, and she probably knows that. Your prison record is an obstacle, but depending upon the charges and your rehabilitation, might not be a deal-breaker. Take care of these obstacles, and THEN get a lawyer to establish a working, bonded relationship with your daughter. Good luck. TC
