Legal Question in Family Law in Texas

My daughter is 2 months old, we currently live with the father. He is not on the birth certificate and we are not married. I want to leave but am afraid. He does not have a job but instead does schooling online, therefore he gets to stay home. My mother currently watches my child while I work.If I leave will he most likely get to keep her during the day while I work? This is something I do not want to happen. Dont get me wrong, I dont want to keep her completely from him...she is just so young.

Because you and he were never married, he has no rights to the child (I assume that you haven't been to court to establish paternity). He is a stranger to the child, and has no more legal right to her than they guy who lives next door.
