Legal Question in Family Law in Texas

My daughter is 5 and her mother and i have joint custody same amount of time with our daughter. She recently told me that she sleeps in the same bed with her mother and her mother's boyfriend. I find that very disturbing. Is that okay and should I be concern because I am not comfortable knowing that is my daughter's sleeping arrangement when she is at her mothers'. No it is not ok.

It sounds like you need to consider (1) family counseling (2) mediation or, as a last resort, (3) modification of the current court orders.

If it makes you feel any better, this accusation happens a lot. Often if the parents just talk, the truth comes out that it (1) never happened (2) it happened once or (3) it happens all the time and mommy's judgment is not good.

Also, your daughter might be exaggerating. It might have happened once and she's testing you to see your reaction. (Yes, kids do this. And that is why small children are not allowed to testify. Remember, many small children have imaginary friends.)
