You can do whatever the particular terms of your agreement allow. If it's silent on the move, I would first send her certified mail that you intend to move to place X on date Y. Give her lots of notice. Make sure she always knows exactly where her child is. She can rescind the agreement at any time and she can come take her child back at any time. As long as you make sure she has all the information necessary to exercise those rights, you probably won't get in trouble.

HOWEVER: On these internet forums, people never tell the entire story...mostly because they can't. Before you take off, please, please, please pay for a consultation with a good family law attorney in your area so that he or she can ask you the million questions we ask folks and then give you advice carefully tailored to your specific case. You must make certain that you are not violating any existing orders or statutes.

Good luck!!
