Legal Question in Family Law in Texas
My daughter told CPS that she hired an attorney in 2008
In 2008 this same attorney represented her on a drug case
In 2008 this same attorney represented her sons' father on a drug case
In 2008 this same attorney represented her on a forgery case
In 2009 this same attorney was sitting in the courtroom at a sentencing on another felony charge for my daughter even though he did not represent her.
In October 2010 this same attorney visited my daughter while she was in jail for probation violation seeking information for her sons' father.
In November this same attorney was hired by my daughters sons father & is now representing him in a custody case where I am the Maternal Grandmother and am the Sole Managing Conservator of this child since 2008 where my daughter is part of the Suit since she is the mother & he is the biological father.Isn't this a conflict of interest and unethical client-Attorney Relationship?
I opened my door on December 31, 2010 to find 2 sets of Documents taped to my front door-"you have been served" & "You are being sued in the interest of the child" from this same attorney representing the sons father. The court hearing was set for January 5, 2011, I did not have adequate time to acquire representation and it had not been 20 days, so I asked this attorney for a reset-he refused. My daughter had not been served notice of this hearing & this attorney said she didn't need to be served it didn't have anything to do with her since the father wanted unsupervised visitation. My daughter is currently in a Substance Abuse Felony program in the Texas Prison System. This attorney told me to just give the father unsupervised visitation and unlimited access and they would "go away" and he would draw up the Orders accordingly. This father was charged and found guilty of Domestic Vilolence with an aggravated assault to my daughter and was placed on probation. He is a recovering Heroin addict who has been out of rehab for 9 mos. He has a history of DUI and DWI and is currently living with a new girlfriend of whom I know nothing about her character. what are my options?
