Legal Question in Family Law in Texas

my daughter

My wife and I have been separated on and off for a year now..which i have been on probation for a year cause she filed family violence on me.which all i did was grab the keys from her..but anyway what i want to know is how can i get to see my daughter and my newborn baby..she won't let me or the grandparents see her.and my newborn baby is due anytime. there is no restraining order or anything saying i can't see her it's just if i go to her house i know her mother will call the police. so my question is..Is there a Judge that can order her to let me see them or am I going to have to file for divorce first? Can you tell me who to go talk to about it or give me some advice. I would like to see becca for christmas,I missed thanksgiving with her and i miss her so much..her grandmother and grandfather miss her also..we haven't gotten to see her since aug 10th. please help me if you can.. thank you,--name removed--M.

Is there a judge that can order her to let you see your kids? Yes. If he gets the right order in time. You don't have to file for divorce, but it sounds like a good idea. You could file a Suit Affecting Parent Child Relationship seeking Temporary Orders and perhaps a Temporary Restraining Order to prevent her from interfering with your visitation. All this costs money. If these issues are important to you, find a lawyer in your area.
