Legal Question in Family Law in Texas

My daughter is six years old, and her biological father has seen her at birth, and one day when she was 14 months old. We have a child support order setup in his state (GA), that my state (TX) assisted with setting up. On the forms, I'm marked the custodial parent. Do I need a custody order that states me as a primary, custodial parent? Or is that area on the child support order enough to establish custody? I am getting married soon to someone in the Army. We're worried that when he receives orders next year (possibly out of country) that there will be a hold up regarding custody, and a further hold up obtaining her passport. If I do file custody papers, is it likely that a judge would award any custody to her bioligical, out of state father?

You will find that there is a provision in your "child support order" that appoints you as the "custodial parent." That's all you need. "Custody" has been established.
