Legal Question in Family Law in Texas

My daughter,her boyfriend, his child, her child and several family members went out to dinner to celebrate a birthday. Her boyfriend was drinking a beer with his dinner and his daughter's mother came into the restaraunt with a camera, took his picture and stated that she wanted to have proof that he was drinking and driving with her "baby girl". He was not driving, nor was his girlfriend (she too had a margerita). A member of the family that was not drinking took them home. Can she use this against him in court?

She can show the photograph in court and testify that it accurately represents what was there that night (in other words, she's testifying that the photo isn't a fake). What a Judge would do with such evidence is anybody's guess ... my guess is that the Judge would say, "Is this all he's done wrong?"

Last I heard, it's legal in Texas for an adult to drink beer.
