Legal Question in Family Law in Texas

My daughters biological father is not really a part of her life. He hasn't seen her in over 4 months, nor does he contact me or my daughter who is 3 years old. He also hasn't been paying child support, and is over $5,000 behind. I am married now to my husband, and he is my daughters primary father figure. When he has gotten her in the past, it is so his parents can watch her or to show off for a new girlfriend. Her father also parties a lot, so when he has her I am concerned about her safety. He has several warrants for traffic violations. He also has gotten fired from his previous job for stealing, and had his car repo. At this point we would like to be done with my daughters biological father all together, and just let my husband adopt her. We want what is best for her, and for her to have a stable home life.
