Legal Question in Family Law in Texas

My daughters father I separated in 2002 He filed for divorced in 2006 no child support was ever ordered in the divorce decree we have joint custody and it states he is supposed to pay half of all expenses for her but has not also it shows he is the primary conservator. She has always lived with me and I have always supported her on my own. We lived in two different counties when he divorced and I still do in texas can I get child support . Single mother seeking child support from deadbeat dad!!!

You need to file a Petition to Modify the Parent-Child Relationship and have primary conservatorship switched to yourself. If the child has been living with you for more than 6 months (as certainly the case), you will almost definitely win (assuming you have no hideous facts that can be used against you). That change in conservatorship will be a material change in circumstances that will trigger the requirement that the court order dad to pay child support to you.
