Legal Question in Family Law in Texas

My daughter's father has not seen her for almost 2 years, and he has not paid any child support in one year. My fiance is the only father she has ever known, so we would like to make it official and have him adopt her. Currently, her biological father and I are joint managing conservators (legally speaking). Am I able to take away his rights as her father so that the man she knows as dad can adopt her?

So get married and after you've been married approximately a year, hire an experienced family law attorney in your county to assist you in the termination and step-parent adoption process.

It is an extremely complex procedure. Actually it is 2 lawsuits that are "loosely" tied into one lawsuit.

You can read about them on my blog - www.txfamilylaw4u.blogspot.com - I blogged about this topic several years ago. I no longer practice family law -- I only mediate these days.

Please do not even think about attempting to do this without an experienced family law attorney.

PLEASE do not waste your time and money with a legal kit from the internet, t.v. or radio -- they won't work in the State of Texas. This sort of legal case is complex and exacting.
