Legal Question in Family Law in Texas

Hi...

My name is Davina and I have a question regarding changing my child's birth name. My son's father, who my son is named after, has been arrested for 1st degree murder. I am pretty sure he will never see the light of day again, considering his past arrests. He has always been an absentee father and has not seen his son since he was 1 1/2 months old. (He is now 4.) My question to you is how am i able to legally change my son's name to my new husband's name without having to ask for permission from his biological father, who is now incarcerated?

However, you might want to wait awhile and consider a termination of rights and step-parent adoption.
