Legal Question in Family Law in Texas

Dead beat Ex Husband

Why is it that my divorce agreement states my ex husband is liable for old credit card bills, and half of my childs medical expenses, yet he doesnt pay and I have no recourse?

When I notified credit card companies, and sent copy of decree, they say I am liable because credit was originally in my name. When and if he does pay, it is sporadic and not even enough to cover f/chrg. Meanwhile, it is ruining my credit, while he has 4 cars and 2 boats, etc. Can I take him back to court w/out costing me a fortune? He doesnt pay any college either, and I cant afford it on my own. I only make 17,000. yearly.

Re: Dead beat Ex Husband

You do have recourse, however it is against your ex-H

and not the credit card companies. Your decree is

essentially a contract between he and you and you may

enforce it AGAINST HIM. The credit card companies

were not a party to your decree and it does not apply

to them. Instead, you entered into a contract with them

when you obtained the card....that is the contract that

they are upholding when they say you must pay. So what

do you do? You file a motion to enforce against your ex-H

and ask for a judgment for all the amounts he owes you.

Then you try to collect the judgment (maybe by selling cars and

boats if possible). I hope this helps.
