Legal Question in Family Law in Texas

Deadbeat

I am a mother of 2 children (age 9) born out-of-wedlock. I am not on any government assistance and have worked very hard to support them. Their father has not helped financially since they were infants. We have had several court appearances and he has failed to show up. Our last court action was June 2002 the case was in default and payments were to begin the following month. Well, its one year later and still nothing. I am writing today to ask a few questions:

1. Can I change their name to reflect my last name? What is the cost, process and procedures?

2. What happens to me if I deny him visitations?

3. Can I seek child support from his househould income by from his mother, wife, etc.

I'm not sure what happened in June 2002.

If he is in contempt of court, you can file contempt against him.

He is responsible for child support. You cannot look to his wife or his mother to pay.

I would encourage you to meet with an attorney to discuss your options.

You will need a certified copy of the last document signed by the Judge. Any attorney you meet with will need this information to determine the appropriate action to take.
