Legal Question in Family Law in Texas
Death of Custodial Parent
I had joint custody with my daughter's mother;however, she was the custodial parent. My daughter's mother died two days ago. I was told that I have to file a modification order to the prior custody order. What do I do? Or do I automatically get custody?

Re: Death of Custodial Parent
Unless someone objects to you having custody, you would get custody. Then there would be a custody fight. Since you are the parent, the person wanting custody would have the burden to prove why you should not have custody of the child.
