death of a custodial parent

my neice is 15 yrs old and has lived with her maternal grandparents since may 2005 due to temporary orders initiated from a CPS case on her mother. the orders have the grandparents and her father as joint conservatorship with the grandparents as primary custodian, now that her mother has died in july 07 she wants to live with her father not the grandparents, the grandparents have filed for legal guardianship ,does he need an attorney or can he just file an answer himself to modify the orders since the mother is now deceased.

He needs a lawyer. Although every litigant has the right to represent himself, the situation you describe is complex, and will require the expertise of an attorney.
