Legal Question in Family Law in Texas

Death of parent

My dad died on 12/25,2008. He was never married and has 10 kids between 3 women. Only one mother put him on child support for 3 kids (I am one). He was receiving disablity checks and hardly ever paid child support. He died without a will and no legal property or monies to his name. Are we entitled to anything after his death? The child support order really doesn't say anything.

Re: Death of parent

The child support order probably says that support payments are an obligation of the paying party's estate. That means his estate owes the remaining support payments.

There are other issues involved in the situation other than child support so I suggest you hire a lawyer.

Re: Death of parent

I'm sorry for your loss, but if he had nothing (no property, no money) there is nothing to get. If you or your siblings are still minors your mother should check with Social Security to see if you might qualify for survivor benefits.
