Legal Question in Family Law in Texas

debt from past marriage

My ex-wife was awarded our car in the divorce three years ago. She never refinanced the car into her name and shortly after the divorce it was repossessed. Now, 3 years later, a firm that aquired the account has filed a law suit against me for the balance, interest, attorney fee's, etc. Am I stuck with it or is a divorce decree with her aquiring it enough to divert the suit to her? And if judgement is against me then how would they expect me to pay for it? I don't have that kind of money.

You could sue your wife to enforce the terms of the divorce decree, but the finance co. was not a party to your divorce and they are not bound by the judgment. If you can't pay and the finance co. won't settle, then you will have to walk around with a judgment around your neck. To some people this is a problem, for other people, you can't tell the difference. Good Luck.
