Legal Question in Family Law in Texas

Debt responsibility

My wife (of 1 year) and I are separated; getting ready to file for divorce. I have bad credit due to a previous marriage where we filed bankruptcy. My new vehicle was purchased in this wife's name and financed at a local credit union.I pay the note. I can't refinance it into my name due to my credit. Can I continue to make the payments and the loan not show up as a debt for her by so stating it in the divorce papers? I definitely can afford the payments. Also, if this arrangement works, how can I make sure the title gets changed to my name? Unless I can resolve this matter, my wife, who is a mite paranoid, says she will contest the divorce and our separate lawyers will cost both of us a small forture. She's not letting me take any furniture, dishes, or gifts that she previously gave me. I really need my vehicle. HELP!!!

Re: Debt responsibility

If the note is in her name, then she is liable to the creditor.

If the divorce is NOT agreed, then it is contested.

What will the Judge do? No one can answer that question with certainty.

Good luck!
