Dependants at TAX time!
In my divorce I agreed to give my X one of our two children as a dependant for taxes becasue I was stupid. We had a verbal agreement between us that I would not "hang him out to dry" so to speak and he would visit the kids anytime and remain a big part of there life. I wanted him to still have money to do things with the kids while in his care. He was already paying his first X $500.00 mo, medical etc... Problem is, now he hardly sees them (not even a yr. later), once ever couple months and no Holidays. Can I have orders changed to get back child to claim as tax dependent. If he don't want to see the kids he dont need the extra money that claiming her gives him!!!

You would have to file a motion to modify and you could allege that this tax exemption for you is in the best interests of the child because it results in greater tax savings to you and more money to spend for her benefit. His record of visitation, etc. can be considered by the court.
