Legal Question in Family Law in Texas

Deployment and Divorce

My husband ask for a divorce while he's deployed to Iraq, we live in Texas and he is coming back to Texas for a 2 week leave but I'm living in Ohio. Can he file for divorce while he is deployed to another country? I don't want the divorce, and really don't have the money at this time to get a lawyer, I'm raising his two children on my own and I don't know what to do at this time. Can you please help? Thank you

Re: Deployment and Divorce

He can direct an attorney to file the petition for divorce. If you can work out a decree with him, including property division, child support and visitation, you can proceed as an uncontested case, either on your own or with an attorney. You can also request that the court order him to pay your attorneys' fees.
