Legal Question in Family Law in Texas
Deposition
I am involved in an affair with a married man.
His wife has filed for divorce.
He has admitted to his infidelity.
I know that I am going to be asked to give an oral deposition.
I do not understand the purpose of me having to volunteer the details of our affair.
1. How can I protect my privacy?
2. What happens if I refuse to give a deposition?
3. What is my legal obligation?

Your second question is the easiest to answer. If you refuse to appear by request, the opposing party can subpoena you or get a court order for your appearance. If you still refuse, you can be held in contempt of court.
As for your privacy and legal obligations, I am not sure what you mean. It should be obvious by now, that the affair is no longer private. You may need to consult with your OWN attorney if you believe that the case will involve issues that make you uncomfortable.
