What determines Common Law marriage in the State of Texas?

(1) Cohabitation and (2) representing oneself to others as being married.

Or (1) cohabitation and (2) an actual agreement to be married - not in the future, but in the present tense. "Jennifer, now that we're living together, let's agree to be husband and wife, right now."

The proper term is "marriage without formalities."

Merely living together does NOT constitute an informal marriage.
