Difficult and disturbing Family situation in Texas

My daughters mother and i are no longer together, we have both remarried and i have not been allowed visitation of my daughter in 2 years( she is 3 1/2 ).. Recently she was removed from her mothers care by C.P.S and placed in foster care for allegations of neglect, we have '' joint custody'' and i have a nother daughter 3 months younger who is prospering and growing just fine in my custody, i have a hearing tommorow but was informed by the C.P.S caseorker that even though i am her biological father she will not allow me to have my daughter duriong this time because i have not been around constantly in her life, whether by choice or not, and i have been incarserated before, is there anything i can do?

I believe that I should be able to help you. Whether or not you initially get custody of your daughter is not the long term concern. Also, it is ultimately not up to CPS to decide. A judge will ultimately make that decision, and they will do what they think is in the "child's " best interest. A parent has great advantages over a nonparent in acquiring ultimate custody.
