Legal Question in Family Law in Texas

Dissolving relationship with property and children

My daughter has been living with a man since @1997. They have 2 children and also bought a home together in 2000. My daughter wants out of the relationship and custody of her children. She has moved out several times of the years. She has asked him to move out but will not. How can she get her equity out of the home and her children since he refuses to sell the house or move out?

Re: Dissolving relationship with property and children

You daughter needs to talk to a good family law attorney. At the very least she is going to need to file a paternity suit to formally have the man named as the children's father and establish child custody and support. As for the real property, a lot depends on whether this is a common law marriage or not.
