Legal Question in Family Law in Texas

Dividing assests aquird during the marriage but have been transfered into my hus

. On Ocotober27, 2000, my husband was sentenced to 40 years along with two more 20 year sentences and also a 25 year sentence all for drug related crimes. It will all run concurrent with the 40 years but it seems to me a lifetime to him i am sure. He was mentally abusive to me and he was very unfaithful to me. I guess the question I need to ask you is what happens to all the stuff we owned together now that he is in prison? Most all of the stuff that he valued the most he put away at his moms house in Eustace , texas. He was ver selfish to me and he never would put my name on any thing or any thing with a title. i am sure that by now ther has taken it all and put it into his moms name. Is theree somethin theat i cand do to make sure that i get a fair chance to get the things that we got while we were married divided evenly? Does he have any right to any of it since her is in prison? I just need some frendly advice about how to get my fair share of our stuff and to make sure that my children get their share when divorce, which we are both wanting to do.

I would appredieat a responce as soon as possible

thank you,

You can sue for a divorce and seek all the property that was in the marriage. A Court Order can be obtained for your mother-in-law to bring everything to you or a court-appointed receiver for safe-keeping until the Court decides how th property should be divided. This can be a moderately expensive process. If you live in Hidalgo, Cameron or Willacy Co., you may call me at 956-424-1644.
