division of inherited property

Could my spouse take part of my inheritance from my parents in the event of divorce? The money has been invested in stock, etc. and kept separate . Any dividends were put into a joint account, which I know is half his. Also, the land that we built our home on is in my name, what are his rights there? He refuses to move out and says that I should move. It is my land.
