Legal Question in Family Law in Texas

Divorce Amendment

I got a divorce about a year ago I was served and never submitted an answer. Can I go back and request a trial to get my name off of the mortgage?

At the time of the petition for divorce my husband and I agreed to work on our marriage and that is the reason I did not answer. Come to find out he went to court behind my back with intentions of getting the house for himself. Can I now amend it or is it to late?

Re: Divorce Amendment

A judge cannot take your name off of a mortgage. You can call the mortgage company and see if they will remove your name. I doubt they will cooperate.

The court loses jurisdiction over the case 30 days after the judge signs the final decree of divorce.

Sorry!
